1. Introductory Provisions
In accordance with Section 1751(1) of Act No. 89/2012 Coll., the Czech Civil Code, these Terms and Conditions govern the mutual rights and obligations arising in connection with a purchase agreement concluded between the Seller and the Buyer through the online store.
The Buyer may be a consumer or a business. A consumer is an individual who enters into an agreement with the Seller outside the scope of their business activity or independent professional practice. Provisions of these Terms and Conditions concerning special consumer protection do not apply to business buyers.
Terms differing from these Terms and Conditions may be agreed in the purchase agreement or in an individual written agreement. Such terms take precedence.
These Terms and Conditions form an integral part of the purchase agreement. The Seller may amend them; the version effective when a particular order is submitted applies to that order.
2. User Account
The Buyer may place orders through a user account or without registration if the website interface permits it.
The Buyer must provide accurate, truthful and current information and protect their login credentials. The Seller may terminate an account, particularly in the event of prolonged inactivity or a serious breach of contractual obligations.
3. Goods and Floristry-Specific Characteristics
Fresh-cut flowers are natural and perishable goods. Individual blooms may naturally differ in shade, size, stage of opening and shape. Photographs in the online store therefore illustrate the overall character and colour palette of an arrangement, rather than guaranteeing an identical appearance of every individual flower.
If a particular flower is unavailable because of seasonality or current supply, the Seller may replace it with a flower of comparable or higher value while preserving the character, colour palette and overall value of the arrangement. Where possible in view of the delivery date, the Seller will discuss any material change with the Buyer in advance.
Goods made or adapted to the Buyer’s specifications include, in particular, individually designed bouquets, bespoke arrangements and other products whose characteristics have been individually changed at the Buyer’s request. Adding a standard gift card does not alter the nature of the other goods in the order.
4. Orders and Conclusion of the Purchase Agreement
The presentation of goods in the online store is for information purposes. The Buyer creates an order by selecting the goods, payment and delivery method and by completing the required information. Before submitting the order, the Buyer may review and correct the entered information.
By submitting an order, the Buyer confirms that they have read these Terms and Conditions and makes a binding order. The purchase agreement is concluded when the Seller accepts the order and sends confirmation to the Buyer electronically.
Depending on the nature, price, delivery location or quantity of the goods, the Seller may request additional confirmation of the order. If the Seller cannot fulfil the order, the Seller will inform the Buyer without undue delay and refund any payment received.
The Buyer is responsible for the accuracy of contact and delivery information, particularly the name, address, telephone number, delivery date and recipient details.
5. Prices and Payment Terms
Prices shown in the online store are final and include all applicable taxes and charges. Delivery costs and any additional selected services are stated separately before the order is submitted.
The purchase price may be paid using the methods currently offered during checkout. The Buyer must pay within the period applicable to the selected payment method.
For orders of higher value, unusual scope, with an express deadline or long-distance delivery, the Seller may request additional order confirmation or payment before preparation begins. This does not in itself alter the payment methods normally available in the online store.
The tax document is issued to the Buyer electronically.
6. Cancelling an Order Before Delivery
This section governs the contractual option to cancel an order before it is fulfilled. It does not limit the Buyer’s rights relating to defective performance or any statutory right of withdrawal where such withdrawal is permitted.
An order for fresh flowers or goods made or adapted to the Buyer’s specifications may be cancelled free of charge no later than 24 hours before the agreed delivery or collection time. The cancellation request must be delivered to the Seller by email at info@ruzemichael.cz or by telephone at +420 739 272 229. The relevant time is when the Seller can demonstrably be shown to have received the request.
For an order placed less than 24 hours before the agreed delivery or collection time, free cancellation may be requested only until the Seller begins sourcing materials or preparing the order.
If an order is cancelled less than 24 hours before the agreed time, after preparation has begun or after dispatch, the Seller may require reimbursement of reasonably incurred costs. These may include the cost of flowers already ordered, processed or rendered unusable, the value of a completed arrangement and delivery costs already incurred. If the order has been completed or dispatched and the goods cannot be resold because of their nature, this amount may be up to the total order price plus any delivery already performed.
If the order has been paid, the Seller may set off the applicable amount against the payment to be refunded. Any remaining balance will be returned to the Buyer without undue delay. If the order has not been paid, the Seller may claim the costs incurred from the Buyer.
7. Delivery, Acceptance and Failed Delivery
The Buyer must ensure that the order can be properly accepted at the agreed place and time. If the order is intended for another person, the Buyer is responsible for the accuracy of the recipient’s details and for ensuring that either the recipient or the Buyer can be contacted during delivery.
Refusal by the recipient, the recipient’s absence, inability to reach the supplied telephone number, an incorrect address or any other failed delivery caused by the Buyer or recipient does not constitute cancellation and does not in itself create a right to a refund.
If the courier cannot hand over the order for reasons attributable to the Buyer or recipient, the Seller is entitled to payment for the goods and the delivery already performed. Redelivery is possible only by agreement, if the condition of the goods permits it, and may be charged separately.
These rules do not apply if delivery failed because of defective goods, a material delay or another breach by the Seller.
The Buyer should inspect the shipment on receipt. Any visible damage should be reported to the Seller without delay and, where possible, documented with photographs. This does not affect the Buyer’s statutory rights arising from defective performance.
8. Consumer Right of Withdrawal
For goods for which the law permits withdrawal, a consumer may withdraw from the agreement without giving a reason within 14 days of receiving the goods.
In accordance with Section 1837 of the Czech Civil Code, a consumer may not withdraw, in particular, from an agreement for the supply of:
- goods liable to deteriorate rapidly or with a short shelf life, especially fresh-cut flowers;
- goods made or adapted to the consumer’s specifications or personalised for the consumer;
- other goods for which the law expressly excludes the right of withdrawal.
For other goods, notice of withdrawal may be sent to the Seller’s registered office or to info@ruzemichael.cz. The Buyer may also use any online tool made available by the Seller for the relevant order.
The consumer must send or hand over returned goods no later than 14 days after withdrawal. The consumer bears the return costs unless the law provides otherwise. The Seller will refund the funds received, including the cost of the least expensive delivery method offered, no later than 14 days after withdrawal; the Seller may wait until the goods are received or the consumer proves that they have been sent.
9. Rights Arising from Defective Performance and Complaints
The Seller is responsible for ensuring that the goods are free from defects upon receipt and conform to the agreed characteristics. A consumer’s rights arising from defective performance are governed by the Czech Civil Code and related legislation.
When assessing fresh flowers, their natural characteristics, usual lifespan and compliance with reasonable care instructions are taken into account. Natural differences in shade, shape or stage of opening do not in themselves constitute a defect if the agreed character and value of the arrangement are preserved.
A complaint may be submitted by email to info@ruzemichael.cz, by telephone at +420 739 272 229 or at the business premises. The Buyer should provide the order number, describe the defect and, where possible, attach photographs. The complaint will be handled within the statutory period.
10. Personal Data, Cookies and Marketing Communications
Information about the processing of personal data is set out in the separate Privacy Policy. The Seller processes personal data required to fulfil an order for the performance of the agreement and compliance with legal obligations.
Marketing communications are sent only in accordance with applicable law, and recipients may unsubscribe at any time. The use of cookies is governed by the information and choices available in the website’s cookie banner.
11. Alternative Dispute Resolution for Consumers
The Czech Trade Inspection Authority, Central Inspectorate – ADR Department, Gorazdova 1969/24, 120 00 Prague 2, Czech Republic, email: adr@coi.gov.cz, website: https://coi.gov.cz/en/information-about-adr/, is responsible for out-of-court resolution of consumer disputes arising from a purchase agreement.
12. Final Provisions
The purchase agreement is governed by the law of the Czech Republic. This does not deprive a consumer of the protection afforded by mandatory provisions of the law that would otherwise apply.
If any provision of these Terms and Conditions is invalid or ineffective, this does not affect the validity of the remaining provisions.
The purchase agreement is stored electronically. The current version of these Terms and Conditions is available on the Seller’s website.
These Terms and Conditions are effective from 7 August 2026.
